Terms and Conditions

Please read these Terms and Conditions carefully before using BoatRoute. By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1 Definitions

The following definitions apply throughout these Terms and Conditions:

"BoatRoute" — the web platform available at boatroute.com and the associated mobile application, operated by Manolescu Sebastian, an individual based in Romania.
"Service" — all features, functions, content, and tools provided by BoatRoute, including the web dashboard, mobile application, map editor, and any related services.
"Operator" — a business or individual (typically a boat rental company) that registers an account on boatroute.com and configures the Service for their clients.
"End User" — a person who uses the BoatRoute mobile application by entering an access code provided by an Operator. End Users do not register directly on boatroute.com.
"Account" — the registered profile created by an Operator on boatroute.com.
"Map Content" — all data entered by an Operator into the Service, including routes, danger zones, place markers, and company information.
"Subscription" — a paid plan that grants an Operator access to the full features of the Service for a defined billing period.
"we", "us", "our" — Manolescu Sebastian, the operator of BoatRoute.
"you", "your" — the Operator accessing or using the Service.

2 Description of Service

BoatRoute is a software-as-a-service (SaaS) platform designed for boat rental companies. The Service enables Operators to:

  • Create and configure an interactive sea map with custom routes, danger zones, and points of interest;
  • Generate a unique access code that their rental clients (End Users) can enter into the BoatRoute mobile application;
  • Manage company information displayed to End Users within the mobile application;
  • Configure push notifications sent to End Users via the mobile application.

The BoatRoute mobile application (available on iOS and Android) is the tool through which End Users view the Operator's map and navigate at sea. End Users interact solely with the mobile application and do not create accounts on boatroute.com.

BoatRoute is a navigation aid only. It is not a certified nautical chart system, a maritime safety system, or a substitute for professional navigation equipment or training. See Section 6 for the full navigation safety disclaimer.

3 Eligibility

To use BoatRoute as an Operator, you must:

  • Be at least 18 years of age;
  • Be acting on behalf of a legitimate business, or as an individual with a legitimate commercial purpose;
  • Have the legal authority to enter into binding contracts in your jurisdiction;
  • Provide accurate and truthful information during registration.

By creating an account, you represent and warrant that you meet all of the above requirements. We reserve the right to refuse or terminate access to any person who does not meet these criteria or who provides false information.

4 Accounts & Registration

To access the full features of the Service, you must create an account using a valid email address and a password of your choosing. You agree to:

  • Provide accurate, current, and complete information at the time of registration;
  • Keep your account credentials (email and password) confidential and not share them with any third party;
  • Notify us immediately at contact@boatroute.com if you suspect any unauthorised use of your account;
  • Take responsibility for all activity that occurs under your account, whether or not authorised by you.

You are also responsible for the security of your app access code — the unique code you distribute to End Users so they can log into the mobile application. If you believe your code has been compromised, you may generate a new one from your account dashboard at any time. We are not liable for any misuse of the app that results from your access code being shared with unintended parties.

Your account must be confirmed via the email verification link we send upon registration. Unconfirmed accounts may have limited access to the Service.

5 Subscription & Payment

Plans. The Service is offered under three subscription tiers — Starter (€20/month), Pro (€40/month), and Fleet (€60/month) — each providing a different set of features as described on the pricing page. We reserve the right to change plan features and pricing with reasonable advance notice.

Billing. Subscriptions are billed on a manual, non-automatic basis. You are responsible for initiating payment each billing period via the payment options available on your account page. Failure to pay will result in suspension of your account and loss of access to paid features.

Payment processing. All payments are processed through PayPal. By completing a payment, you also agree to PayPal's terms of service. We do not store your payment card details. Any payment disputes must be resolved through PayPal's dispute resolution process.

Refunds. All payments made to BoatRoute are considered on a case-by-case basis. There is no automatic entitlement to a refund for any subscription period already paid. If you believe you are entitled to a refund due to exceptional circumstances (such as a technical failure on our part that prevented you from using the Service for a significant portion of the billing period), please contact us at contact@boatroute.com and we will review your request in good faith. We are not obliged to issue refunds for change of mind, non-use of the Service, or cancellation mid-period.

Taxes. Stated prices do not include VAT or other applicable taxes. You are responsible for determining and paying any taxes applicable to your use of the Service in your jurisdiction.

6 Navigation Safety Disclaimer

This is the most important section of these Terms. Please read it carefully. BoatRoute is a navigation aid only. It must never be relied upon as the sole means of navigation at sea. Misuse of the Service could result in serious injury, death, or property damage.

You acknowledge and agree to the following:

  • Not a certified chart. BoatRoute does not provide certified nautical charts. The maps displayed within the Service and mobile application are for general informational purposes only and are not validated against official hydrographic surveys or maritime authorities.
  • User-generated content. All routes, danger zones, and place markers shown in the mobile application are entered by the Operator (you). We do not verify, validate, or approve any Map Content. We make no representation that any Map Content is accurate, current, or complete.
  • GPS limitations. GPS accuracy can be affected by weather conditions, signal interference, device hardware, and geographic factors. BoatRoute is not responsible for inaccurate positioning data.
  • Not a substitute for professional equipment. The Service is not a replacement for certified nautical charts, VHF radio, radar, or any other safety equipment required or recommended for sea navigation. Operators must ensure their clients are aware of and comply with all applicable maritime safety regulations in their jurisdiction.
  • Operator responsibility for End Users. As an Operator, you are solely responsible for ensuring that the Map Content you provide to your rental clients is accurate and appropriate. You must not use BoatRoute as the primary or sole method of communicating safety information to End Users.
  • No liability for marine incidents. We expressly disclaim all liability for any accident, injury, death, property damage, loss, or any other harm that occurs at sea or in connection with the use of the Service or the mobile application, including but not limited to harm caused by inaccurate Map Content, GPS errors, app downtime, or reliance on the Service as a primary navigation tool.
  • Navigation at own risk. All navigation undertaken using BoatRoute — whether by the Operator or by End Users — is done entirely at the user's own risk.

7 User-Generated Content

Ownership. You retain ownership of all Map Content and other data you enter into the Service. By submitting Map Content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and transmit that content solely for the purpose of providing the Service to you and your End Users. We do not claim any ownership rights over your Map Content.

Your responsibility. You are solely responsible for the accuracy, legality, and appropriateness of all Map Content you create. This includes:

  • Ensuring that danger zones accurately reflect real hazards in your area;
  • Ensuring that routes do not pass through restricted maritime zones, protected areas, or areas that are dangerous or illegal to navigate;
  • Keeping your Map Content up to date as conditions change;
  • Ensuring that your company information is accurate and not misleading.

Data retention on cancellation. If your subscription lapses or your account is terminated, your Map Content will be retained on our servers for a period of 30 days following the date of cancellation or termination. After this period, all Map Content associated with your account will be permanently deleted and cannot be recovered. It is your responsibility to export or back up any data you wish to keep before this period expires.

Our right to remove content. We reserve the right to remove any Map Content that we reasonably believe violates these Terms, applicable law, or poses a genuine safety risk, without prior notice and without liability to you.

8 Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation, including maritime laws and data protection laws;
  • Enter Map Content that is false, misleading, defamatory, or intended to deceive End Users;
  • Enter Map Content that knowingly omits danger zones or hazards, thereby creating a safety risk for End Users;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
  • Use automated tools, bots, or scripts to access, scrape, or interfere with the Service;
  • Attempt to gain unauthorised access to any part of the Service, its servers, or databases;
  • Share your account credentials or access code in a way that enables use of the Service by parties who have not agreed to these Terms;
  • Use the Service to transmit spam, malware, or other harmful or unsolicited content via the notification system;
  • Resell, sublicence, or commercially exploit the Service without our prior written consent.

Violation of this section may result in immediate suspension or termination of your account without refund.

9 Third-Party Services

The Service integrates with and relies on third-party services. By using BoatRoute, you acknowledge that your use of the Service is also subject to the terms and privacy policies of the following third parties:

  • PayPal — used for payment processing. We do not receive or store your payment card details. See PayPal's terms at paypal.com.
  • Google Firebase & Firebase Crashlytics — used within the mobile application to collect anonymised usage analytics and crash reports for the purpose of improving the Service. These tools may collect device identifiers and usage data as described in Google's Privacy Policy.
  • Google Maps — used to render the interactive map within the web dashboard and mobile application. Your use of map functionality is subject to Google Maps' terms of service.
  • BoostedHost — our web hosting provider, on whose servers your account data and Map Content are stored.

We are not responsible for the availability, security, or practices of any third-party service. If a third-party service becomes unavailable or changes its terms, we will make reasonable efforts to find an alternative but cannot guarantee uninterrupted functionality.

10 Intellectual Property

All intellectual property rights in the BoatRoute platform, including but not limited to the software, design, user interface, branding, logos, and documentation, are owned exclusively by Manolescu Sebastian. Nothing in these Terms grants you any right, title, or interest in the Service beyond a limited licence to use it as described herein.

You are granted a non-exclusive, non-transferable, revocable licence to access and use the Service solely for its intended purpose — managing your boat rental company's navigation content — for the duration of your active subscription.

You may not copy, reproduce, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

11 Limitation of Liability

No warranties. The Service is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Limitation. To the maximum extent permitted by applicable law, Manolescu Sebastian shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of revenue, profit, data, goodwill, or business opportunity;
  • Damages arising from accidents, injuries, or incidents at sea, howsoever caused;
  • Damages arising from inaccurate Map Content entered by you or another Operator;
  • Damages arising from Service downtime, data loss, or security breaches beyond our reasonable control;
  • Damages arising from reliance on GPS data, third-party maps, or any other navigational information provided through the Service.

In any case where liability cannot be fully excluded by law, our total aggregate liability to you shall not exceed the total amount paid by you for the Service in the three (3) calendar months immediately preceding the event giving rise to the claim.

Indemnification. You agree to indemnify, defend, and hold harmless Manolescu Sebastian from and against any claims, losses, damages, costs (including legal fees), and liabilities arising out of or in connection with: (a) your use of the Service; (b) Map Content you have entered; (c) your breach of these Terms; or (d) any claim by an End User arising from the use of the mobile application with your access code.

12 Service Availability

We will make reasonable efforts to keep the Service operational and accessible. However, we do not guarantee any specific uptime or availability level. The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance;
  • Server or infrastructure failures beyond our reasonable control;
  • Failures of third-party services (hosting, payment processing, mapping APIs);
  • Force majeure events including natural disasters, cyberattacks, or government actions.

Temporary unavailability of the Service does not entitle you to a refund unless the downtime is sustained (more than 72 consecutive hours) and directly attributable to our systems. In such cases, refund requests will be considered on a case-by-case basis.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. In the event of a permanent discontinuation of the Service, we will make best efforts to notify you in advance, though we cannot guarantee a specific notice period. Upon permanent discontinuation, any unused portion of a paid subscription period may be considered for a partial refund at our discretion.

13 Termination

By you. You may stop using the Service and close your account at any time by contacting us at contact@boatroute.com. Closing your account does not automatically entitle you to a refund for any remaining subscription period.

By us. We reserve the right to suspend or terminate your account immediately and without prior notice if:

  • You breach any provision of these Terms;
  • We reasonably believe your use of the Service creates a safety risk for End Users;
  • We receive credible reports that you are using the Service for unlawful purposes;
  • You fail to make payment for two or more consecutive billing periods;
  • You engage in abusive, harassing, or threatening behaviour toward us.

Effect of termination. Upon termination, your access to the Service will cease immediately. Your Map Content will be retained for 30 days as described in Section 7, after which it will be permanently deleted. Termination does not limit any other rights or remedies available to us.

14 Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. When we make material changes, we will notify you by email to the address associated with your account at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may close your account before the effective date.

The current version of these Terms will always be available at boatroute.com/terms_and_conditions, with the "Last updated" date shown at the top of this page.

15 Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms — including disputes relating to their formation, validity, binding effect, interpretation, performance, breach, or termination — shall first be attempted to be resolved amicably through direct negotiation between the parties.

If the dispute cannot be resolved amicably within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the competent courts of Romania.

If you are a consumer resident in another EU member state, you may also be entitled to bring proceedings in the courts of your country of residence under applicable EU consumer protection law. Nothing in these Terms limits your rights as an EU consumer.
